Accessing, browsing, and downloading images from our website implies acceptance and consent to these Terms of Use and Image License. Please read them carefully.

1. Copyright, Ownership and License Grant

1.1 Ownership and Creation Process

All the images available on Pixelust are the result of a creative process that includes:

• The use of artificial intelligence tools (including models like Gemini).
• Careful formulation of instructions ( prompting ), post-production (finishing) and any changes carried out by the Pixelust Creative Team.

The images thus created/generated and offered for download are the Property of Pixelust , as described and granted in the Terms of Use of the artificial intelligence tools used.

1.2 Standard License Grant AI Images

Pixelust grants the end user (you) a worldwide, perpetual, non-exclusive, non-transferable license to download and use the Images, subject to your compliance with the Prohibitions and Restrictions set forth in Section 2 (Prohibited Uses).

• Scope of Use: The images can be used freely for both personal/private and commercial purposes .
• Attribution: Optional Attribution (Required, but not required): Attribution to pixelust.net is not required, but is strongly encouraged (if technically and reasonably possible) and is always appreciated and left to the user’s discretion.

2. Permitted Use and Restrictions (Prohibited Uses)

2.1 Permitted Use

Images can be incorporated into a wide range of projects, including:

• Editorial and advertising projects (e.g., marketing materials, blogs, articles).
• Content for social media and online platforms.
• Graphics and web design (e.g. backgrounds, layouts).

2.2 Prohibited Uses (Absolute Restrictions)

You are not authorized to perform the following actions:

1. Prohibition of Resale and Redistribution of the Original File

1. Reselling the Bare Asset: You may not sell, rent, lease, sublicense, or distribute the Images in digital format “as is” or as a stand-alone file.
2. Distribution as Stock Images: You may not redistribute the Images in collections, stock image databases, or similar services, whether free or paid.

1. Modification Prohibited: You may not modify, retouch, alter, manipulate, or create derivative works based on the downloaded Images. The Image must be used in its entirety as provided.

• Exception: Only minimal technical changes necessary for embedding are permitted (e.g., resizing for web or print, optimizing the format without altering the visual appearance).

1. Prohibited Content: Using the Images to create, promote, or distribute any illegal, harmful, obscene, defamatory, libelous, pornographic, hateful, or violent material is strictly prohibited.
2. Deceptive Use: You may not use the Images in any way that might imply an endorsement of your product or service by Pixelust, and you may not use the Images for any activity that might damage Pixelust’s reputation or image.
3. AI Training: You may not use the Imagery for training, improving, or developing Artificial Intelligence or Machine Learning models.

3. Disclaimer of Warranties and Limitation of Liability

3.1 Disclaimer of Third Party Rights and Assumption of Risk

Pixelust is committed to generating Images through AI, using prompts and processes designed to strictly exclude infringements of third-party intellectual property rights.

However, despite this rigorous care and diligence in generation , Pixelust cannot guarantee that the Images are completely free from potential infringements of copyright, trademarks, or other pre-existing rights of third parties. This is because it is technically impossible to completely eliminate the risk that the AI model may inadvertently generate an image that strongly resembles an existing logo, protected character, work of art, or photograph.

• User Responsibility: You acknowledge and accept this residual risk. You are solely responsible for your use of downloaded images and assume full responsibility for ensuring that such use (particularly for branding, logo, or service mark purposes) does not infringe the intellectual property rights of third parties.
• Disclaimer: Pixelust disclaims any legal responsibility for any disputes, copyright claims, or damages that may arise from your use of the images.

3.2 General Terms

The Pixelust service and all its contents (including Images) are provided on an “as is” and “as available” basis .
